By accessing or using towerpeak.lat, you agree to these Terms. If you do not agree, do not use our website or services. These Terms are a binding agreement between you and Tower Peak.
Definitions. Tower Peak is operated by De'an County Bang Ding Network Technology Co., Ltd., Room 011, 16th Floor, Science and Innovation Center Building, High-tech Industrial Park, De'an County, Jiujiang City, Jiangxi Province, 332000, China. Services means systems design, integration, engineering, and consulting. Website means towerpeak.lat and its subdomains. You means the person or entity using our Website or Services.
What we provide. We offer professional computer systems design, integration, and engineering within the Computer Systems Design sector. Specific project scope, deliverables, schedules, and fees are set out in separate signed agreements. In case of any conflict between these Terms and a signed agreement, the signed agreement takes precedence for that project.
Intellectual property. Everything we create, including designs, code, documentation, and deliverables, remains our property unless otherwise agreed in writing. After full payment, you receive a license to use deliverables created specifically for you, for internal purposes only. This license does not transfer ownership of underlying intellectual property. Our brand name, logo, and trademarks may not be used without written permission.
Your responsibilities. You agree to provide accurate information when we need it, use our website and services lawfully, not damage or interfere with our systems, not attempt unauthorized access, and not use bots or scrapers without our permission. If you engage our services, you also agree to provide timely access to the information, resources, and personnel reasonably needed to complete the work.
Confidentiality. Both sides agree to keep confidential any non-public information exchanged during our work together. This duty continues for five years after the relationship ends. It does not apply to information that becomes public through no fault of either side, was already known, is independently developed, or comes from a third party not subject to confidentiality.
Liability. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, including lost profits or data. Our total liability is limited to the amount you paid us for the specific service that gave rise to the claim, or USD 100, whichever is less. This does not apply to death, personal injury, fraud, or liability that cannot be excluded by law. Our services are provided as is, without any warranty, express or implied.
Indemnification and termination. You agree to defend and indemnify us from claims arising from your use of our website or violation of these Terms. We may suspend or end your access at any time if we believe you have violated these Terms, and provisions that should naturally survive termination will continue to apply. We may modify these Terms by posting an updated version, and continued use constitutes acceptance of the changes.
Governing law and general terms. These Terms are governed by the laws of the People's Republic of China. Disputes shall first be resolved through good-faith negotiation; if unresolved within 60 days, the courts of Jiujiang, Jiangxi, China have exclusive jurisdiction. If any part of these Terms is unenforceable, the rest remains in effect. These Terms together with any signed service agreements constitute the entire agreement between us. Our failure to enforce a right does not waive it.
